Article 6: Application for Use of Service 1. All Members must provide their real name and a valid email address to use the Service. The use of the Service may be restricted if invalid information is provided. 3. A real name must be provided for Member enrollment. 4. The Company may not approve the use of Service for any one of the following reasons: - If a User's application has been submitted using a false name or the name of a third party. - If a User's application has been submitted using false statements or documents. - If a User is registered as having poor credit (PC communication, Internet service, etc.) pursuant to the Use and Protection of Credit Information Act. - If a User's application has been submitted for the purpose of hindering social well-being or morals. - If a User is registered as an objectionable user (PC communication, Internet service, etc.) by the Korea Communications Standards Commission. - If a User's application does not satisfy other requirements as specified by the Company. 3. If an application for use of service satisfies any one of the following criteria, the Company may withhold approval until such time when the reason for withholding has been resolved: - If the Company is unable to assess the application for service due to insufficient equipment/facilities. - If the Company is experiencing technical difficulties. - If approval is not viable due to other reasons attributable to the Company. 4. The Company shall promptly notify the applicant if an application is not approved or is restricted. 5. The Company may restrict approval if an applicant is a minor. Chapter 3: Rights and Obligations of Contracting Parties Article 9: Rights and Obligations of the Company 1. The Company shall promptly process any complaint from a Member if it's deemed to be justified. If immediate processing of the complaint is not feasible, however, the Member shall be notified of the reason and processing schedule via letter, email, or telephone call. 2. The Company has an obligation to protect the personal information of Users in accordance with the Privacy Policy established by the Company. However, this may not be the case if required in the interpretation of legitimate procedures in accordance with the provisions of laws and regulations in the Republic of Korea. 3. Notwithstanding the stipulation prescribed in Paragraph 2, the Company shall notify Members individually to obtain consent if the Company is to exceed the scope of notified or stated purpose to use or provide personal information to a third party. 4. To provide a continuous and stable Service, the Company shall repair or restore any equipment in the event of a failure or loss without undue delay. However, the Service may be suspended or discontinued in the event of a natural disaster, emergency, or other unavoidable circumstance. 5. The Company shall provide convenience to Members with respect to contractual procedures and contents (signing of Usage Agreement, changes to content, termination, etc.). 6. With respect to business procedures, the Company may generate and utilize statistical data on the personal information of all or a part of its Members with prior consent and transmit HTTP cookies to a Member's computer via the Service. In such cases, Members may refuse to accept cookies or change web browser settings on their respective computers to be alerted when an attempt to transmit an HTTP cookie is made. Changes in Service usage due to changes in HTTP cookie settings shall be the responsibility of the Member. Article 10: Rights and Obligations of Members 1. A Member shall not engage in any of the following activities when using the Service: - Misuse of another Member's ID and/or Password. - Reproduction, performance, broadcast, display, distribution, publication, or offering to a third party any information obtained via using the Service, whether by copying, processing, translating, or performing derivative work. (Does not apply to personal use) - Any libelous or slanderous act. - Infringement of the copyrights of the Company or third parties or violation of other rights. - Dissemination of information, writing, figures, recordings, or other medium in violation of public order and/or morality. - Any act objectively recognized as being associated with crime. - Registration or dissemination of computer viruses that infect data and/or cause inconvenience or malfunction of equipment related to the Service or destroy information. - Transmission of information that may interfere with the stable operation of the Service or advertising against a recipient's intent. - Any act that is subject to corrective requests from reputable agencies such as the Korea Communications Standards Commission or consumer protection organizations. - Violation of the Public Official Election Act that is subject to suspension, warning, or corrective measures by election commissions. - Any act contrary to other relevant laws and regulations. 2. A Member shall comply with the terms, conditions, service instructions, and precautions stipulated in these Terms of Use, as well as any notice posted by the Company, whether publicly or individually. 3. A Member shall not use the Service to perform any business without the express prior consent of the Company, and the Company shall not be liable for any consequences thereof. 4. A Member shall be liable for damages to the Company in connection with any unwarranted business activities as stipulated above in Paragraph 3. 5. A Member may not transfer, grant, or provide as collateral the status of these Terms of Use or other usage agreements to a third party. 6. A Member may not transfer the contents and functions of all or any part of the Service without prior approval of the Company. 7. If a User requests the viewing and/or correction of his/her personal information via visitation or use of an electronic signature or ID, the Company shall confirm the User's identity and take necessary action without undue delay. 8. If a User's legal representative requests the viewing and/or correction of the User's personal information via visitation, the Company may request the submission of proof of proxy relationship. 9. The Company shall arrange procedures for collecting User opinions and handling complaints regarding personal information. Chapter 4: Use of Services Article 11: Service Hours 1. The Service shall be operated 24 hours per day, 7 days per week, unless otherwise disrupted due to legitimate reasons. However, the Company may suspend the Service on the day and/or at the time previously set by the Company for periodic system maintenance or expansion and/or replacement of equipment. Suspension of Service due to scheduled work shall be announced on the Company's website in advance. 2. The Company may not notify Users in the event the Service is interrupted for reasons beyond the Company's control (disk failure without system administrator intent or fault, system breakdown, etc.), advance notification is not feasible, or the system is interrupted due to the intent or negligence of others (telecommunications company, intermediate carrier, etc.). Article 12: Management of User ID 1. A Member shall be fully responsible for his/her own ID and Password management. 2. In the event a Member's ID is used improperly, the Member must notify the Company of the fact without undue delay. Article 13: Management of Posted Material 1. The Company may delete, move, or refuse to register posted material without prior notice for any one of the following reasons: - If the material is offensive or defamatory to another Member or a third party. - If the material disseminated or linked is in violation of public order and/or morality. - If the material promotes piracy or hacking. - If the material is for commercial purposes. - If the material is for commercial purposes. - If the material infringes upon the copyright or other rights of another User or third party. - If the material fails to comply with the rules stipulated by the Company or does not conform to the nature of the website's bulletin board. - If the material is determined to be in violation of other relevant laws and regulations. Article 14: Copyright of Posted Material 1. A Member may not arbitrarily process or sell information acquired via the use of the Service or use posted information for commercial purposes. 2. The Company may delete, move, or refuse to register Member-posted material without prior notice if the content is determined to violate any one of the stipulations prescribed in Article 13. Article 15: Provision of Information 1. The Company may provide Members with a variety of information deemed necessary during the use of the Service via email, telephone call, or other forms of communication. Article 16: Ad Serving and Transactions with Advertisers 1. A portion of the investment base for the Service that the Company provides is generated via revenue from ad serving. Members consent to the display of advertisements in the Service. 2. The Company shall not be liable for any loss or damage arising from Member involvement, communication, or transaction in promotional activities of advertisers posted on or obtained through the Service. Chapter 5: Termination of Agreement and Restrictions on Use of Services Article 17: Changes to and Termination of Agreement 1. If a Member intends to terminate the Usage Agreement, the Member must terminate the agreement via the "Cancel/Terminate Membership" menu on the Company's translation portal website. Article 18: Restrictions on Use of Services 1. The Company may restrict the use of the Service if a Member violates any stipulation under Article 10 of these Terms of Use or for any one of the following reasons: - Use of a vulgar ID or nickname in violation of public order and/or morality. - Use of a vulgar ID or nickname in violation of public order and/or morality. - Interfering with other normal Service operations - If a request for correction is stipulated by the Korea Communications Standards Commission or other relevant public institution. - Illegal website. - Uploading/transmission of commercial software or illegal files. - Posting obscene materials that violate Article 7 of the Korea Communications Standards Commission's deliberative bylaws. - Including content intended to perform anti-state activities. - Unauthorized duplication or uploading/transmission of copyrighted material (documents, mp3, etc.) - Disseminating computer viruses or malware intended to cause the malfunction of communications equipment or destruction of information. 2. Temporary suspension or termination of Service provision or termination of Usage Agreement may be performed without prior notice, in accordance with the above restrictions on usage, against Users deemed to be objectionable. Chapter 6: Compensation for Damages and Miscellaneous Matters Article 19: Scope and Claim of Damages 1. The Company shall not be liable for damages attributable to force majeure (e.g., natural disaster) or Member intent or negligence. 2. In the event an unlawful act is performed by a Member while using the Service and the Company receives a claim for damages, lawsuit, or other complaint from a third party other than said Member, the Member shall endeavor to indemnify the Company. Should the Company fail to be indemnified, the Member shall compensate for all damages incurred by the Company. English Article 20: Disclaimer 1. If Service is unable to be provided due to natural disaster, war, or other force majeure, the Company shall be exempt from liability. 2. The Company shall be exempt from liability for any loss incurred due to termination or failure of telecommunications services by a telecommunications carrier. 3. The Company shall be exempt from liability for damages caused by unavoidable reasons such as maintenance, replacement, periodic inspection, or construction of service equipment or facilities. 4. The Company shall not be liable for any disruption of or damage to the Service attributable to a Member. 5. The Company shall not be liable for any damage caused by a User's computer error or negligent loss of a Member's personal information and/or email address. 6. The Company shall not be liable for the contents, including the factual reliability or accuracy thereof, of various information or data posted on the Service by a Member. 7. The Company shall not be liable for any damage arising in connection with the mutual transaction of goods (including intangible goods) between Members or a Member and a third party via the Service. 8. The Company shall not be liable for any damage in connection with the use of the Service provided free to Members by the Company. Article 21: Jurisdiction and Dispute Mediation 1. Matters not specified within these Terms of Use shall be governed by the Telecommunications Business Act and other relevant laws and regulations of the Republic of Korea. 2. In the event a dispute arises between the Company and a Member regarding the use of the Service, litigation shall not be possible unless the two sides have first made an earnest attempt to resolve the dispute. 3. If a lawsuit is filed against a dispute arising from the use of the Service, the lawsuit shall be resolved via the competent court having jurisdiction over the Company's headquarters location. (the "Company") respects the personal information of Members and complies with the Act on the Promotion of Information and Communications Network Utilization and Information Protection. The Company shall notify, via the Privacy Policy, Members of the purpose and methods in which the personal information provided is utilized, as well as the actions that are performed for the protection of privacy. The Company shall notify Members via announcement on the Company's website or individual notices when the Privacy Policy is revised. ο This Privacy Policy shall be effective as of December 1, 2017. ■ Personal Information Collected The Company collects the following personal information for membership enrollment, consultation, service application, and payment. ο Types of Information Collected: Name, login ID, password, mobile phone number, email address, bank account information, service usage history, access log, cookie, access IP information, billing/payment history ο Personal Information Collection Method: Website (membership enrollment) ■ Purpose of Collection and Use of Personal Information The Company shall use collected personal information for the following purposes: ο Implementation of contract as it pertains to the provision of service; provision of service-related billing material; purchase and payment processing; goods shipping and billing; financial transaction authentication and related services; fee collection ο Personal identification as it pertains to membership management and service usage; individual identification; prevention of fraudulent or unauthorized use by objectionable Members; enrollment confirmation; age verification; complaint handling; delivery of notices ■ Personal Information Retention and Usage Period As a rule, the Company shall destroy the personal information of Members without undue delay after the purpose of collection and use has been achieved. The procedure and method of destruction are as follows: ο Procedure The information provided by a Member for membership enrollment or other purpose is moved to a separate database (or filing cabinet for paper-based information) after the purpose is achieved. The information is stored for a certain period of time (see Personal Information Retention and Usage Period) according to internal policy and other relevant laws and regulations and destroyed thereafter. Any personal information transferred to a separate database shall not be used for any purpose other than retention unless otherwise required by law. ο Method - Personal information stored in the form of electronic files shall be deleted using a technical method that renders the data irrecoverable. ■ Provision of Personal Information As a rule, the Company does not provide the personal information of Users to external parties. However, exceptions may be made for the following reasons: - If a User has provided consent in advance. - If a request is made by an investigating authority in accordance with relevant laws and regulations of the Republic of Korea and pursuant to procedures and methods set forth therein. ■ Consignment of Collected Personal Information The Company shall not consign the personal information of Members to third parties without prior consent. Should such a need arise in the future, the Company shall notify the Member regarding the information consignee and the purpose of consignment. If necessary, prior consent shall be obtained. ■ Rights of Users and Legal Representatives Users or authorized legal representatives may at any time view and/or modify the personal information of themselves or a dependent under the age of 14 or request membership termination. A User or dependent under the age of 14 may view or modify personal information by clicking "Change Personal Information" (or "Edit Profile," etc.) or terminate membership by clicking "Terminate Membership" (withdrawal of consent) and confirming identity. As an alternative, a Member may contact the Privacy Officer via written letter, telephone call, or email to have the respective request processed without undue delay. If the correction of an error in personal information is requested, said information shall not be used or provided until the corrective measure has been completed. If said incorrect personal information has already been provided to a third party, the third party shall be notified of the corrective measure without undue delay. Personal information that has been destroyed or deleted at the request of a User or legal representative shall be processed by the Company as specified under Personal Information Retention and Usage Period, and such information shall be processed so that it cannot be viewed or used for other purposes. ■ Installation, Operation, and Denial of Automatic Personal Information Collection Devices The Company does not operate devices that automatically collect generated personal information when using Internet services.
